Terms of Use, Privacy & Shipping Policy
Terms of Use and Health & Safety Disclaimer
Parties and acceptance
These Terms of Use (Terms) govern your access to and use of the Soul Tide Foundations website and online store (the Site www.soultidefoundations.com). By accessing the Site, creating an account, or placing an order you agree to be bound by these Terms.
Nature of services
Soul Tide Foundations is a commercial brand and provider of products and informational resources only. We do not provide medical, psychological, or other regulated health professional services. Nothing on the Site is intended to constitute medical, mental health, or other professional advice. Products and resources are for general information and lifestyle purposes only and are not a substitute for professional assessment, diagnosis, treatment or supervision.
Health and safety disclaimer
Soul Tide Foundations is not responsible for any aspect of an individual’s physical, emotional or mental health. All products and resources are intended to be used only under the supervision or guidance of a registered, licensed and currently practising health care provider or support service where appropriate. You must seek independent professional advice before using any product or following any guidance that could affect your health or wellbeing.
Charity, Fundraising and Donations
Brand status and fundraising activities
Soul Tide Foundations is a commercial brand and is not a registered charity, not a not‑for‑profit entity, and not a fundraising service. Any reference on the Site to donations, charitable campaigns, cause partnerships or similar activities is an expression of our commercial or philanthropic initiatives and does not mean Soul Tide Foundations is a charity.
How donation campaigns operate
From time to time we may run campaigns where a portion of sales, a specific product’s proceeds, or separate customer donations are directed to third‑party charities or community organisations. When we run such campaigns, we will endeavour to describe: (a) the campaign period; (b) the beneficiary organisation(s); (c) the mechanism by which funds are collected and transferred; and (d) whether and how donors or customers will receive confirmation or receipts.
No warranty about beneficiaries and verification
We do not warrant, guarantee or endorse the charitable status, governance, use of funds, tax deductibility, or conduct of any third‑party beneficiary. If tax deductibility or registered charity status is important to you, you should verify the beneficiary’s status directly with the organisation or the Australian Charities and Not‑for‑profits Commission before donating.
Liability for fundraising and donations
To the maximum extent permitted by law, Soul Tide Foundations accepts no liability for the acts or omissions of third‑party charities or organisations that receive donations through our campaigns. Where we facilitate the collection or transfer of donations, our role is limited to collection and remittance in accordance with the campaign terms we publish.
Refunds, remedies and statutory rights
Statutory guarantees: Nothing in this policy limits your rights under the Australian Consumer Law. If a digital product has a major failure you may choose a refund or replacement; for minor problems we will offer an appropriate remedy in accordance with the ACL.
Discretionary refunds: For change‑of‑mind requests we generally do not provide refunds once a digital file has been downloaded or access granted, because the product cannot be returned in a resalable form. We may, at our discretion, offer a refund, replacement file or store credit in exceptional circumstances.
Important: A “no refunds” statement does not override ACL rights; we will comply with statutory remedies where applicable.
How to request a refund or report a fault
- Fault reports: Email support with your order number, description of the issue and supporting evidence (screenshots, error messages) as soon as practicable.
- Assessment: We will acknowledge receipt and assess the claim within 10 business days and advise the outcome and remedy.
- Remedies and timing: If a refund is approved, we will refund to the original payment method within 14 business days of approval. If a replacement file or repair is offered, we will supply it promptly.
Exclusions, limitations and practical points
- Change‑of‑mind: No refund after download except at our discretion.
- Third‑party content: If a product incorporates third‑party content or licences, remedies may be limited to what we can reasonably provide as retailer.
- Fraud and chargebacks: We reserve the right to investigate suspected fraud and to refuse refunds where misuse or fraudulent activity is evident.
Shipping and Delivery Policy
This Shipping and Delivery Policy explains how Soul Tide Foundations delivers digital products purchased from our Site. It applies only to digital downloads; we do not ship physical goods at this current time. For information about refunds, consumer rights and other legal matters, see our Terms of Use and Refund Policy.
How delivery works
Delivery method: Digital products are delivered by email.
Timing: Delivery is usually immediate once payment is authorised. In some cases, payment or fraud checks may delay access by up to 24 hours. If delivery is delayed beyond this period we will notify you and provide an estimated time for access.
Order confirmation and download access
Order confirmation: After purchase you will receive an order confirmation email containing your receipt and a download link or instructions to access the product.
File formats, compatibility and storage
File formats: Product listings specify the file format(s) provided. It is your responsibility to ensure you have the necessary software or device to open and use the files.
Backup: We recommend you download and back up purchased files promptly. Soul Tide Foundations is not responsible for data loss after you have successfully downloaded a file.
Failed delivery and troubleshooting
Common issues: If you do not receive your download link, first check your spam/junk folder and confirm the email address used at checkout. If the link has expired or the file will not download, contact support with your order number and screenshots or error messages.
Support response: We will acknowledge fault reports and delivery issues as soon as practicable and aim to resolve them within 10 business days.
Refunds, replacements and remedies
Statutory rights: Your statutory rights under the Australian Consumer Law are not affected by this policy. If a digital product has a major failure, you may be entitled to a refund or replacement.
Discretionary refunds: Because digital products cannot be returned in resalable form, change‑of‑mind refunds are not generally available after download, except at our discretion. For full details see our Refund Policy and Terms of Use.
Security and fraud prevention
Payment processing: We use third‑party payment processors and do not store full card details. Delivery may be delayed while we or our providers complete fraud checks.
Fraud investigations: We reserve the right to investigate suspected fraud and to withhold or reverse delivery where misuse or fraudulent activity is evident.
International customers and taxes
Availability: Digital products are available worldwide unless a product listing states otherwise.
Taxes and duties: Prices shown at checkout include any applicable taxes where required. You are responsible for any local taxes or duties that may apply in your jurisdiction.
Changes to this policy
We may update this Shipping and Delivery Policy from time to time. Material changes will be posted on the Site with an updated effective date. Continued use of the Site after changes are posted constitutes acceptance of the updated policy.
